The final regulations implementing the Americans with Disabilities Act Amendments Act of 2008 (ADAAA) were published in the United States Federal Register on March 25, 2011. The amended act broadened the reach of the original ADA in such employment activities as hiring, reasonable accommodation, and training of individuals with disabilities.
Less than four months later, on July 6, 2011, Verizon Wireless and twenty four of its subsidiary companies entered into a $20,000,000 consent decree with the United States Equal Employment Opportunity Commission to settle charges relative to the company’s policies denying reasonable accommodation to employees with disabilities. This event clearly signaled the potential cost of employers for non-compliance with the law’s tenet regarding accommodation of individuals whose physical or cognitive impairments resulted in barriers to the enjoyment the benefits of employment.
