Disability-Related Inquiries and Medical Examinations
An area of concern for employers and staffing agencies is asking individuals disability-related questions while attempting to stay in compliance with ADA Title 1. The same concern exists when a medical examination (post-offer testing, physician examination, or functional capacity evaluation) of a conditional hire or incumbent worker appears to be in order.
Staying in compliance when asking disability-related questions or requiring medical examinations is based on the phase of employment of the employee (i.e., application, pre-offer, post-offer, on-the-job, or absent).
